Imagine stepping into a bustling casino, the scent of money mixed with excitement thick in the air. For many, it’s a place full of hope and chance. But for one hard of hearing patron, it quickly turned into a nightmare. This is the story of a couple, both regular attendees of their local commercial casino, who found themselves facing a significant discrimination issue after an unfortunate incident that has since escalated.

Our protagonist, who we’ll call Alex, has been hard of hearing for most of their life. Thankfully, they had a supportive partner, Jess, who was hearing and often accompanied Alex on trips to the racino. Recently, they participated in a promotional event that promised a grand prize of over $50,000. As players gathered to claim their prizes, a stringent five-minute rule was enforced. Unfortunately, Alex’s hard of hearing status became a barrier when they confronted a casino employee about needing an American Sign Language (ASL) interpreter to understand the process.

The employee on duty, however, made it clear that the casino did not provide interpreters. Frustrated, Alex attempted to lip-read the instructions but quickly realized they had misinterpreted crucial information: they only needed to match all five numbers in any order, not in sequence as initially conveyed. After the time limit expired, and their prize was denied, Alex and Jess decided to escalate the matter, hoping that a more formal inquiry could resolve the misunderstanding.

When they approached the front desk with a series of questions, they were met with resistance. Instead of receiving help, another employee brought in the same individuals who had denied Alex’s claim. Recording the interaction, Alex sought clarity but was met with dismissive attitudes and repeated denials regarding the need for an interpreter. Highlights from the recording showed that instead of assisting, the casino staff questioned Jess repeatedly about her ability to interpret for Alex. Confused, Alex tried to explain that she couldn’t do so adequately, but the situation only worsened.

“You can read, right?” one staff member said, suggesting that Jess could simply translate the information, ignoring the fact that she wasn’t fluent in ASL. The refusal to even document the questions Alex had posed led to an intense confrontation. At one point, when Alex attempted to write down their issues on a sheet of paper provided by them, the manager on duty pulled the pen away. Alex’s video captured the moment of confusion and frustration, culminating in the head of security threatening to force them off the property.

Fast forward a week later, during another promotional event, Alex encountered the same issues. This time, there was no visual display for the winners either, making it impossible for anyone unable to hear to know if they had won. Wanting to advocate for themselves, Alex approached a security guard to inquire about the need for an interpreter once more. The response was swift and shocking; they were once again asked to leave the casino, citing previous “problems” as the reason.

The exchange was recorded in its entirety, as Alex felt it was necessary to document their experiences. The security manager insisted that they had caused enough trouble, and when Alex tried to seek a better understanding of the situation, they were met with hostility. All they wanted was equal access to the promotions offered, but instead, they were labeled a nuisance and escorted out.

This incident left both Alex and Jess feeling bewildered and disillusioned. They had always enjoyed their time at the casino, but now it felt hostile and unwelcoming. In response, they filed complaints with the Kentucky Horse Racing Commission and the Department of Justice, drawing attention to the unfairness of the situation and the lack of accommodations for hard of hearing patrons.

As their story unfolded, it captured the attention of online communities that advocate for disability rights. Through sharing their experience, Alex hoped to not only find legal advice but also raise awareness about the systemic issues within places meant for entertainment and chance. The couple was determined to ensure that they were heard, and not just pushed aside because of a lack of understanding or accommodations.
